Welcome to Weather the Storm Outreach (“WTSO”, “we”, “us”, “our”). Our mission is to be a community of substance users, by substance users, for change. These Terms of Service (“Terms”) govern your access to and use of our website, newsletter, Discord Community Hub, professional courses, and all other related current or future services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully.

1. Acceptance of Terms

By creating an account, subscribing to our newsletter, joining our Discord server, or otherwise using any of our Services, you confirm that you are at least eighteen (18) years of age and have the legal capacity to enter into this agreement. You agree to comply with these Terms and all applicable local, provincial, national, and international laws and regulations.

2. CRITICAL DISCLAIMER: Not a Medical or Crisis Service

This is a peer-support community, not a substitute for professional medical advice, diagnosis, treatment, or crisis intervention. Your safety is our highest priority, which means ensuring you get the right level of care when you need it.

  • No Medical Advice: The content and information provided through our Services, including from the founder, volunteers, or community members, are for informational and peer-support purposes only. They do not constitute medical, psychological, or therapeutic advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or heard through our Services.

  • IMMEDIATE HELP & EMERGENCY SITUATIONS: Our Services are not monitored 24/7 and are NOT a crisis intervention service. We cannot provide immediate help.
    If you are in crisis, believe you may harm yourself or others, or are experiencing a medical emergency, your first and best course of action is to contact your local emergency services.

3. Community Guidelines & Code of Conduct

To maintain a safe, respectful, and supportive environment, you agree not to:

  • Harass, Bully, or Discriminate: Engage in any form of harassment, hate speech, bullying, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected status.

  • Share Illegal Content or Promote Illegal Activities: This includes discussing the sale or acquisition of illicit substances. Discussions should be focused on support, harm reduction, and recovery.

  • Violate Privacy: Share personal information about another user without their explicit consent. Respect the anonymity and privacy of all members.

  • Provide Medical or Clinical Advice: As stated above, do not present yourself as a medical professional or provide prescriptive advice. Sharing personal experiences is welcome; giving medical directives is forbidden.

  • Spam or Solicit: Do not use our Services for commercial solicitation, spam, or to promote your own services without prior written consent from WTSO.

  • Impersonate Others: Do not impersonate any person or entity, including Scott Roose or any WTSO representative.

Violation of these guidelines may result in content removal, a temporary suspension, or a permanent ban from our Services at our sole discretion.

4. Description of Services

WTSO offers a phased array of services:

  • Free Services: The bi-monthly newsletter and the private Discord Community Hub are provided free of charge to foster community and provide accessible support.

  • Paid Products & Services: We plan to offer paid products and educational courses, including future products and Professional Development Courses ("Paid Services"). All prices are listed in Canadian Dollars (CAD) unless otherwise specified. Payments are processed through secure third-party vendors.

  • Refunds: Due to the digital nature of many of our Paid Services, we generally do not offer refunds. For the physical products, returns will be subject to a separate return policy available at the point of sale. For professional courses, refund policies will be clearly stated in the course registration materials.

5. User-Generated Content

You are solely responsible for any text, images, information, or other content you post or share within our Services ("User Content").

  • Ownership: You retain ownership of your User Content.

  • License to WTSO: By posting User Content, you grant WTSO a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Services. For example, we may need to reproduce your comments to display them in the Discord server.

  • Right to Remove: We reserve the right, but not the obligation, to monitor and remove any User Content that we believe, in our sole discretion, violates these Terms or is otherwise harmful to our community.

6. Intellectual Property

All content and materials provided by WTSO as part of the Services, including but not limited to the brand name Weather the Storm Outreach, our logos, the design and content of our current and future products and the curriculum and materials for our professional courses, are the exclusive intellectual property of Scott Roose, operating as Weather the Storm Outreach. You may not copy, reproduce, sell, or distribute our proprietary materials without our express written permission.

7. Privacy

Your privacy is critically important to us. Our collection and use of your personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms. Our practices are designed to be compliant with the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada.

8. Termination

You are free to stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services, at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.

9. Limitation of Liability & Indemnification

As Weather the Storm Outreach operates as a Sole Proprietorship, this section is of particular importance.

  • Disclaimer of Warranties: The Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, WTSO and its founder, Scott Roose, disclaim all warranties, express or implied, in connection with the Services and your use thereof. We do not warrant that the Services will be uninterrupted, error-free, or secure.

  • Limitation of Liability: In no event shall WTSO or its founder, Scott Roose, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory. Our total liability to you for any claims arising from the use of the Services is limited to the greater of (a) the amount you have paid us for Paid Services in the last 12 months, or (b) one hundred Canadian dollars ($100 CAD).

  • Indemnification: You agree to defend, indemnify, and hold harmless Weather the Storm Outreach and its founder, Scott Roose, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from your use of and access to the Services or your violation of any term of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the provincial laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Chatham, Ontario, Canada, and the parties irrevocably consent to the personal jurisdiction and venue therein.

11. Changes to Terms

We may modify these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
